Terms of service

In consideration of the mutual agreement made for any project submissions, both parties (Client and K) agree as follows:1) The project will be completed within a reasonable, non-rush schedule to be determined, where possible, and mutually agreed upon at the start of the project. Late or weekend hours incurred to accommodate additional compressed deadlines, if needed, will be negotiated separately. Schedule will assume timely review and response by client of all deliverables.2) The client will share the following information:- Project Usage
- Details of the Project, including character information, poses, references, colors, background, etc
- File dimensions
- Client's contact information
- Additional information that may be relevant to the project, such as deadlines, questions, etcFailure to provide sufficient information may lead to the project being rejected.3) Only the client has full authority to provide and obtain all necessary information, including sketches, revisions, and approvals throughout this project. If the client has someone on their behalf to authorize, please communicate this to K.4) Payment will be done through Ko-Fi/Paypal, and will require 40% of the estimated payment upfront before initiating. If the deposit paid is higher than the final cost, a refund of the excess will be issued within 3 - 5 business days. Should the project or relationship be terminated for any reason after it is initiated, a kill fee of up to 40% of the initial payment will be taken for compensation of any completed work, and the remaining payment after the kill fee will be refunded within 3 -5 business days. Likewise, if the payment is not received within a reasonable period of time from our communication, the project will be terminated.5) Revisions will be done on a case-by-case basis. If revisions are major enough to warrant a re-draw, this may incur an additional fee of 5 - 25% of the total project cost and will be billed to the final cost.6) The project will be rejected due the following:- NSFW
- Gore
- Hate
- Dehumanize
- Rape
- Extreme fetishes
- NFT usage
- AI art implementation
- Any harassment or improper buyer etiquette to KLikewise, K will suspend all communications if the client chooses to edit, copy, remove signature/logo, or claim K's art as their own.7) K reserves all rights to the project. This includes using samples of the project for publications, streams, portfolios, exhibitions, competitions and other promotional purposes.8) If the project is non-commercial, the client may use the project for personal use. The client may not use the project for reselling purposes, including past, present, or future products, vendors, marketing, advertisements, auctions, and other proprietaries.9) The following credit will be mentioned on all publicity/promotions of this project and/or our relationship, including, but not limited to: streams, videos, social media, blogs, publications, press releases, etc.: Artist: K.Lemiscus
